Dealer GOUGED my Spark

I stored my new 2up Spark with the dealer in October of 2014. I made up some stickers and put them on every part that could be removed so they would not mix them up with others. I inspected the Spark thoroughly in the dealer parking lot before they took it in. It was in perfect showroom condition with only 4 hours on it. Well I went to pick it up yesterday, I saw it outside and went to look at it before going in to check it out. The first thing I saw was a 5 inch gouge in the hull. I could not believe it, it is a brand new machine, I was so upset. I went in to the dealer and spoke to the service person and the sales manager who sold it to me. To make a long story story short they said they would make it right but I will have to deal with the service manager who was not there at the time. I have to go in tomorrow(Monday) to speak to the Service manager. I know 100% it was not there when I checked it over before storing but I do not have any proof. The service person said that they write down any damage before it is stored and there is nothing written down on the report about the gouge.
I feel that they may do the right thing but is a repaired hull a compromised hull. Should I push for a new hull, I am still very upset not sure what to say to the service manger. Don't know what my rights are.

If they didnt note the scratch on the hull then its on them. Quite obviously that was cut by something sharp like a forklift bar . As far as integrity its pretty thick there and just a quick melt and fill with a plastic welder with a flush grind should do the trick. But of course they are responsible to make the machine whole again.
Thanks wizzer, I will use that line tomorrow if I have to. It's hard to think straight when I am still so upset. Been also torchering myself by looking at the pictures, I now noticed that there is a scrap before the scratch which suggests it slipped somewhere. May have been when loading back on trailer because they stored it on a rack. I wish I would have taken pictures before they stored it. Lesson paifully learned.
Start with wanting a new hull and see what they offer to compensate for the scratch. Price out a hull and if they just fix it, you better be getting some accessories for free.

Spoke to the service manger today, first words out of her mouth was " I can't see how we damaged it here, .....but we will do our best to fix it". Then you can look at it and we can take it from there. Did not want to discuss anthing further. She said she will call me in a few days. I'm hoping I won't have anymore lssues, guess we will see. Will keep postig til resolved.

Are you dealing with Brampton Power Sports?
Yes it was taken off the trailer and stored. The dealer has been in contact with me and they are trying their best to do the right thing. After the service manager contacted me I feel that they will. I do not want to disclose the dealer as of yet, I will keep posting until issue is fixed.
Dealer just called says my Spark is ready for pick up. It has been repaired and they say they are pleased about the way it looks. I am going to ask for a writen guarantee on the repair for as long as I own it. Lets face it, it was new going in so I think that would be more then fair. If it even splits or cracks in that spot I am screwed. I am also expecting they will eat my storage/winterizing bill as well for all the STRESS I have had. I agree with serpent710 they should offer me some accessories for all my trouble, I could really use some and it would be a nice gesture.
Funny thing is my son wants to buy a bike this summer and my sister loved my Spark and wants to buy a 3up/with ibr. Depending on how all this is finalized will also depend on where these new purchases are made. :)

For me I would rather the dealer just did a weld repair as opposed to replacing the hull. Taking a hull apart on the clock may just lead to much more potential problems with engine alignment and water leaks ect when a tech who doesnt really care or know what they are doing gets involved.
now if the hull had a hole torn through it that would be a different story but yours is a gouge. For sure have them guarantee in writing that the repair is covered for at least within the warranty period. Takes pics and have the service writer sign them. Just to cover all bases just in case.

LOL. That's the thing with math there is always a logical answer.
I think the probability of you being a Brampton Powersports employee is very high. That's ok with me, accidents do happen, I have posted nothing but the truth.

Well, I picked up my Spark on Saturday. The repair was done better then I expected, from some angles you can't even see it. When you look at it from some other angles it looks like little blotches or water marks. All I'm hoping now is that the repair lasts and I don't have anymore problems with it.
Okay, I have had tons of private messages asking me who the dealer is and what they should do for me besides the repair. Let me start with what was done besides the repair. They did guarantee the repair for as long as I own the Spark, which I feel is fair. I was asked to pay for my storage/winterizing at a reduced rate which I negotiated BEFORE the storage/damage. I'm I happy?, I am happy to have the Spark home but I feel something further should have been done for me. I went in with a new hull and now have a repaired hull which I am sure reduces the trade in value even if I trade it in with them. I did not say anything and just paid the bill, did not feel I would get too far.
As for who the dealer is, I was not going to reveal who they are but NetAtNite has already done that.

Congrats on having it home! A shame they had to make you find out it was there on your own. I definitely hope I do not come across a situation like this at the dealership I bring my spark too because customer service is not their specialty. Enjoy the summer!

Thank you, hoping to have a great full summer this year since I bought it in August last year and did not. Then I had some bad luck and bad weather and only put 4 hours on it.
As for the dealership, the more I think about it the more disappointed I am in the lack of customer service. They never once admitted fault even though there was no record of the damage in their notes when they stored it. If they did not want to admit fault, I understand but they did NOT even apologize for any inconvenience or stress I may have had. The dealership is 28 km/17.5 miles away from my house and I went there 4 times during the whole ordeal. Should have gone there only once, so that is 168 km/105 miles more then what I should have driven. I feel like emailing the General manager about the whole thing but not sure I would get anywhere, lack of customer service may come from the top.
NO apologies, NO compensation of any kind and still charged me for the storage.

So don't contact the GM AND go straight for the owner. I would not allow something like that to go un-done
